Jan. 25, 2021—A Los Angeles judge dismissed a lawsuit that was brought against a Long Beach auto repair shop on Friday, the Long Beach Post reported.
The suit was brought on behalf of the children of an 85-year-old man who died three days after slipping and falling at Junior & True Automotive.
The judge found no proof of service was filed on the defendants, the shop owner, or the shop. But the ruling was “without prejudice,” meaning the plaintiffs can resume the case with a proper explanation.
According to the report, employees of the shop allegedly opted not to call 911 after the man fell, instead driving him to his home where he fell a second time, The man suffered a right hip fracture that caused a hemorrhage and shock. He later went into respiratory distress and never recovered.
