The judge found no proof of service was filed on the defendants, the shop owner, or the shop. But the ruling was “without prejudice,” meaning the plaintiffs can resume the case with a proper explanation.
According to the report, employees of the shop allegedly opted not to call 911 after the man fell, instead driving him to his home where he fell a second time, The man suffered a right hip fracture that caused a hemorrhage and shock. He later went into respiratory distress and never recovered.
