NY Senate Passes Right To Repair Bill

The legislation was passed with one key piece absent.

June 15, 2021—The New York State Senate has approved Right to Repair legislation, but not for the automotive industry.

The bill would require “OEMs to make available, for purposes of diagnosis, maintenance, or repair, to any independent repair provider, or to the owner of digital electronic equipment manufactured by or on behalf of, or sold by, the OEM, on fair and reasonable terms, documentation, parts, and tools, inclusive of any updates to information or embedded software.”

However, vehicle manufacturers were left out of those who will be required to make information more readily available. 

Since Right to Repair legislation was passed in Massachusetts last November, the industry has been fighting for those laws to take effect. The legislation is currently held up in the courts as vehicle manufacturers claim releasing the information would be a security risk. The trial for the case began Monday and is expected to last about a week
