ACA Issues Notice About State PFAS Compliance Requirements Updates

Starting in 2026, Washington and Minnesota will implement strict PFAS regulations, including reporting and banning certain automotive waxes and wash products containing PFAS, requiring manufacturers to adapt their compliance strategies and submit detailed reports.

The Auto Care Association issued a notice to its members regarding compliance requirement updates in Washington state and Minnesota that took effect January 1, 2026, that may affect sellers and product manufacturers in the automotive industry.

Washington State: PFAS Reporting and Ban

Automotive Wax: Manufacturers must report intentionally added PFAS in wax products sold in Washington. Tracking requirement took effect Jan. 1, 2026; reports due Jan. 31, 2027, and annually thereafter. Detection above 50 ppm total fluorine is presumed intentional unless rebutted.

Automotive Wash: Manufacture, sale, and distribution of wash products with intentionally added PFAS is banned starting Jan. 1, 2027. Reformulation or market withdrawal is required if above the threshold.

Who submits: The entity that had the product manufactured. A trade organization may file on behalf of member manufacturers. Only one report per product is required.

Reporting portal: HPCDS — Interstate Chemical Clearinghouse. Use Chrome — does not work in Internet Explorer.

Minnesota: PFAS Reporting Deadline

Manufacturers must report intentionally added PFAS in products sold in Minnesota and pay a one-time $800 fee. Initial reports due by Sept. 15, 2026.

Applies to all manufacturers, including online-only sales and importers/first domestic distributors.
